Terms of Service

1. Agreement

These Terms govern your use of the Power CRM application ("the Service"), distributed through the GoHighLevel marketplace. By installing the Service into a GoHighLevel account, or by using it, you agree to these Terms. If you are agreeing on behalf of an agency or company, you confirm you have authority to bind it, and "you" means that entity.

2. What the Service is

Power CRM is an application that installs into your GoHighLevel account and adds client onboarding, data management, AI-assisted data capture, documents, meetings, calendar, custom data, fax and permissioning capabilities on top of the CRM. It requires an active GoHighLevel account. It is not a replacement for GoHighLevel and it does not provide the underlying CRM.

Independence. Power CRM is an independent application. GoHighLevel and HighLevel are trademarks of HighLevel Inc. We are not affiliated with, endorsed by, or sponsored by HighLevel Inc. Your relationship with GoHighLevel is governed by your own agreement with them, and your use of GoHighLevel remains subject to it.

3. Licence

Subject to these Terms and payment of the applicable fees, we grant you a non-exclusive, non-transferable, revocable right to use the Service for your internal business purposes and for the delivery of services to your own clients, for the term of your subscription.

You may not: reverse engineer or decompile the Service; resell or sublicense it except as expressly agreed in writing; use it to build a competing product; circumvent usage limits; or remove proprietary notices.

4. Your account and your team

You are responsible for the activity of every user you grant access to, for keeping credentials secure, and for the accuracy of the roles and permissions you configure. Tell us promptly at support@power-crm.com if you believe an account has been compromised.

5. Your data and your clients' data

You retain all ownership of your data and your clients' data. You grant us only the rights necessary to operate the Service for you — to read from and write to the GoHighLevel account you authorized, to cache that data, to queue and reconcile writes, and to process it through the sub-processors listed in our Privacy Policy.

You are responsible for having a lawful basis for the data you put into the Service and for the messages the Service sends on your behalf to your own clients — including onboarding reminder emails and SMS text messages, which are sent from your own GoHighLevel account, under your brand, with you as the sender. If you enable SMS reminders you are responsible for prior express written consent, for STOP/HELP handling, and for A2P 10DLC registration of the sending number, as set out in the Privacy Policy. GoHighLevel remains your source of truth. On uninstall we delete the installation, the stored tokens and part of the cached data automatically; the remainder is deleted on request — the Privacy Policy states exactly what each covers.

6. Acceptable use

You will not use the Service to:

• break any law, or infringe anyone's rights;
• send unsolicited bulk messages, or contact people who have not consented to hear from you;
• store or transmit malicious code;
• attempt to gain unauthorized access to the Service, other customers' data, or GoHighLevel;
• abuse the GoHighLevel API, or deliberately circumvent its rate limits;
• upload data you are not permitted to process.

We may suspend the Service immediately for a material breach of this section.

7. AI features and generated output

The Service includes AI features that generate field values, field descriptions, chat answers and meeting action items. These are assistive and probabilistic. Generated output may be inaccurate or incomplete even when grounded against a client's website, business listing and DNS records.

You are responsible for reviewing AI output before relying on it. That is why generated values arrive with their status intact and pass through your own approval flow. We make no warranty as to the accuracy, completeness or fitness for purpose of any AI-generated content, and we are not liable for consequences arising from your use of unreviewed AI output.

8. Fax and telecommunications

The Fax module is delivered through a third-party carrier. If you enable it you are responsible for complying with all applicable telecommunications and fax laws in every jurisdiction in which you or your clients operate, including rules on unsolicited fax advertising, consent, opt-out handling and record retention (for example, in the United States, the Telephone Consumer Protection Act and the Junk Fax Prevention Act). You are also responsible for any confidentiality or sector-specific obligations attaching to the documents you transmit, including health information. Carrier charges may apply to provisioned numbers and to transmissions.

9. Fees

The Service is a paid product. Fees are agreed with you in writing based on your GoHighLevel sub-account count and the modules you enable. Unless stated otherwise in your order, fees are billed in advance, are exclusive of taxes, and are non-refundable for a period already begun. We may change fees on renewal with reasonable notice.

10. Availability and support

We work to keep the Service available and to recover quickly from failures, but we do not warrant uninterrupted or error-free operation. The Service depends on GoHighLevel and other third parties, and we are not responsible for outages, rate limits, breaking changes or discontinuations originating with them.

11. Warranty disclaimer

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data, however caused. Our total aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

13. Indemnity

You will indemnify us against claims arising from your use of the Service in breach of these Terms, from data you put into it without a lawful basis, and from messages or faxes sent through it to recipients who had not consented to receive them.

14. Termination

You may terminate at any time by uninstalling the application from GoHighLevel. We may terminate or suspend for material breach, non-payment, or unlawful use. On termination your licence ends and we delete data as described in the Privacy Policy. Your data inside GoHighLevel is unaffected — it was always the source of truth.

15. Changes to these Terms

We may update these Terms. Material changes will be notified to installed customers by email, and the date at the top of this page will be updated. Continuing to use the Service after a change takes effect means you accept it.
